Terms and Conditions
Welcome to Monitoreal Limited (“Monitoreal”)! These Terms and Conditions (“Terms”) govern your access to and use of Monitoreal’s products, services, and website (collectively, the “Services”). By purchasing or using our products and Services, you agree to be bound by these Terms. Please read them carefully before using our products or website.
1. Acceptance of Terms
By using Monitoreal’s products and Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Services.
2. Monitoreal Services
Monitoreal provides privacy-centric, on-premises video security solutions that process video data locally on your device. Unlike traditional cloud-based systems, your data is not stored or processed on the cloud unless you choose to opt into optional premium services. Our base product allows for self-monitoring without any subscription fee.
a. Self-Monitoring
Our devices are designed for local processing of video data, allowing you to monitor your property without the need for a subscription. No video data is sent to or stored on our servers unless you opt for additional services.
b. Premium Services
Optional premium services may be available for a monthly fee. These services provide enhanced functionality and additional features, such as cloud-based storage or advanced alerts. Terms and conditions specific to premium services may apply, and will be provided at the time of registration.
c. Software Updates
Your Monitoreal device requires periodic access to the internet to receive essential software updates, which may include new features, bug fixes, and security enhancements. By using our products, you agree to allow Monitoreal to deliver these updates remotely to ensure the optimal performance of your device.
d. Remote Alerts
To send security alerts and notifications to your smartphone or other devices remotely, your Monitoreal system will need internet access. While Monitoreal strives to ensure the timely delivery of alerts, we cannot guarantee their delivery due to factors outside of our control, such as network interruptions or third-party service failures.
3. User Responsibilities
a. Compliance with Local Laws
You are solely responsible for ensuring that your use of Monitoreal products complies with all applicable local, state, national, and international laws and regulations, particularly in relation to the use of video surveillance and data privacy. You agree not to use the Monitoreal system for any unlawful purpose or in any manner that could violate the rights of others.
b. Installation and Use
You are responsible for the proper installation, configuration, and maintenance of your Monitoreal device. Monitoreal shall not be liable for any damages or loss caused by improper installation, use, or failure to follow Monitoreal’s instructions.
c. Security of Your Device
You are responsible for maintaining the security of your device and network. We recommend using strong, unique passwords and taking appropriate precautions to prevent unauthorized access to your Monitoreal system.
4. Data Privacy and Security
a. Local Data Processing
Monitoreal processes video data locally on your device, and no video footage or customer data is sent to our servers unless you have opted in for specific premium services. Your privacy is of paramount importance to us, and we have designed our systems to minimize data transmission to the extent necessary for functionality.
b. Data Transmission for Alerts
To send security alerts to your remote devices, certain metadata, such as event notifications, may be transmitted over the internet. However, this data does not include video footage unless you have explicitly enabled this feature in your settings.
c. Optional Cloud Services
If you opt-in for Monitoreal’s premium services, some data may be stored or processed in the cloud, depending on the service selected. Monitoreal will only collect and store the data necessary to provide the chosen services, and your data will be handled in accordance with our Privacy Policy.
5. Product Warranty and Limitations
a. Limited Warranty
Monitoreal provides a limited warranty for its hardware products purchased from an authorized reseller, covering defects in materials and workmanship under normal use for a period of 12 months from the date of purchase (24 months if purchased in the EU). If your product is found to be defective during the warranty period, we will, at our option, repair or replace it. This limited warranty does not cover damage caused by misuse, neglect, unauthorized modification, or external factors.
b. Disclaimer of Warranties
To the maximum extent permitted by law, the Services are provided “as is” and “as available” without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Monitoreal does not warrant that the Services will be uninterrupted, error-free, or completely secure.
6. Limitation of Liability
To the fullest extent permitted by law, Monitoreal and its affiliates, suppliers, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, arising from or relating to your use of our products and Services.
7. Indemnification
You agree to indemnify, defend, and hold Monitoreal and its officers, directors, employees, and agents harmless from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from your use of the Services or your violation of these Terms.
8. Changes to Terms
Monitoreal reserves the right to modify these Terms at any time. We will provide notice of changes by updating the “Last Updated” date at the top of these Terms. Continued use of our products and Services following such changes constitutes your acceptance of the revised Terms.
9. Governing Law
These Terms and any disputes arising out of or related to these Terms or the Services shall be governed by the laws of Cyprus (EU), without regard to its conflict of law principles.
10. NFR (Not For Resale) Program
Units sold under the NFR program, offered at significant discounts off MSRP, are intended for non-commercial use such as internal evaluation, testing, or demonstration. These units may be brand-new or refurbished, with the latter potentially showing signs of prior use. All NFR units are sold “as is” and are verified to be in good working condition. Limited warranty coverage is provided, and standard support may not be available. NFR units are not for resale or distribution and are meant for internal purposes only. By purchasing an NFR unit, the buyer agrees to these terms.
11. Use of Release Candidate (RC) Software
By opting to run the Release Candidate (RC) version of our software, customers acknowledge that they are accessing experimental features and capabilities not yet officially released. These features may contain bugs and defects, and performance is not guaranteed to be stable or consistent. The RC software is provided on an “as is” basis, and its use is at the customer’s own risk. Customers should expect that the RC software may not perform at the same level as the stable, production version and may require updates or fixes before achieving the reliability of officially released software. Additionally, any features available in the RC software are not guaranteed to remain free and may later be released as paid premium features.
